**IMPORTANT NOTE** – PASSPORT COPIES MUST BE SUPPLIED FOR ALL PARTICIPANTS IN ORDER TO ABSOULTELY CONFIRM THE AIRFARES. PHOTOCOPIES ARE ACCEPTED. PLEASE MAKE THIS A PRIORITY REQUEST TO ALL PARENTS AS SOON AS POSSIBLE.

Please read these terms and conditions carefully as they apply to your Tour and to all bookings accepted by EDU SCHOOL TOURS in conjunction with the Tour Operators. The Tour is sold subject to the terms and conditions contained in or referenced to in this document (“Agreement”).  If you instruct us to book the Tour, you accept and agree that these terms and conditions form part of the Agreement

 

PRICES

The price of the Tour as stated in the Tour Proposal is an estimate and is subject to change as referred to in the Agreement. You agree to accept increases and changes to the price in the circumstances set out in the Agreement.

 Airfares and rates are subject to change until the price of the Tour is paid in full.  At times airlines may increase taxes and wholesalers/ground operators may increase rates. If we are given advance notice of any increase, we will contact you and offer you the option of making payments to cover these components to avoid incurring any increases. Airline tax increases are dependent on the cost of oil and wholesaler/ground operator rate increases will be due to currency exchange rates (USD). 

Inclusions The price of the Tour is set out in the Proposal. The price includes only the inclusions listed in the Proposal. 

Exclusions The price of the Tour does not include costs associated with obtaining passports, vaccinations, completing or obtaining pre-existing medical condition forms for travel insurance, room upgrades from that specified in the Proposal, meals other than those specified in the Proposal, any beverages or excess baggage fees. Optional activities you may choose to engage in that require payment that are not included in the Proposal. It is your responsibility to ensure settlement of any charges made by a hotel (all hotels require your passport and validation of a credit card upon check in) for extra services ordered by you such as room service, mini bar, laundry, and communication charges such as telephone, fax, email or items of a personal nature.

Changes in prices and itineraries: The price of the Tour in the Proposal is provided as a guide only and may vary, for example due to peak demand periods, changes in surcharges, fees or taxes, or currency fluctuations. Please confirm all prices and information with your consultant before booking. The price of the Tour may change at any time until the total price has been paid, due to the increase in or variation of supplier surcharges, fees, or taxes, airfare restructures or if any existing surcharges, fees, taxes are varied. If we have to change any part of your booking for reasons beyond our control, for example, if an airline changes its schedules, if an hotelier overbooks, or if there are any changes in applicable surcharges, fees or taxes, we will notify you. If any such changes result in your Tour costing more or otherwise being materially different, then you may cancel the Tour and we will refund any monies already paid less any charges imposed by suppliers.

 The Price of the Tour is based on a minimum number of 20 passengers. If the minimum number of passengers is not reached, the tour may be cancelled by Edu School Tours with all monies refunded to Group Members. Edu School Tours may offer an alternative, in which case Edu School Tours will provide a new Tour Proposal.  If you decide not to proceed, all monies will be refunded in accordance with the Refunds and Cancellations section of this Agreement. Or you may choose to continue with the Tour at an increased price, in which event, services and activities in the Tour may be modified to accommodate a smaller group.

Prices Policy: All costs and prices in the Proposal are per person, including Twin Occupancy (two guests sharing a hotel room) and include planning, handling and operational charges, and are based on current rates of exchange, tariffs and taxes as of the date of the Proposal. Edu School Tours reserves the right to adjust the Price of the Tour to cover changes in costs, tariffs, fees, surcharges and taxes and to reflect fluctuations in foreign exchange markets, of which we become aware after Proposal. You must pay any such increase as a result of any such adjustment before departure.

 

DEPOSITS AND PAYMENTS

The Proposal sets out the payment timeline.

Full payment for your Tour is required at least 60 days prior to departure. If for any reason your balance is not received by us by the due date; we reserve the right to treat your booking as cancelled and to apply the appropriate cancellation charges

Payment of the deposit holds services requested but does not guarantee the Price.

Credit Card payments will be subject to applicable merchant charges.

 

BOOKING REQUIREMENTS

Tour Proposal document must be signed and returned within 14 days of Tour Approval.  Additional passengers MAY be facilitated, dependent on seat availability (flights) and accommodation availability. Any changes in passenger number or Tour participants may affect the Tour price

 

REFUNDS AND CANCELLATIONS

Cancellations: If you cancel or terminate the Tour or your participation in it after payment of the deposit there will be no refund of your deposit.  All cancellations must be made in writing.  If you cancel or terminate your Tour your right to refund will be limited as follows:

  • Prior to final payment: Forfeiture of deposit and forfeiture of any additional supplier deposit paid.
  • After final payment: Forfeiture of deposit and there may be cancellation fees charged by airlines, hotels and ground operators amounting to all or part of the cost paid, for which you acknowledge you are liable.

 Cancellation refunds and forfeitures will be calculated on a case-by-case basis (ie. Depending on circumstances and reasons for cancellation).

 If you leave the Tour early, for any reason, we will not refund any unused part of your Tour.

 Refunds: No refund will be given for missed or unutilized services including flights, accommodation, or sight-seeing included in the Proposal for any services arranged by Edu School Tours. No allowances or refunds will be made for lost or unused tickets or hotel vouchers.

 

ALTERATIONS

Alterations: Any alterations to your Tour, must be made in writing as soon as possible.  Additional changes may be levied by hotels, ground/cruise operators or airlines. An alteration means an amendment to an existing booking and not a transfer to another package. If you make any changes, alterations or amendments to your Tour after departure, you accept full liability for any additional costs or changes incurred or charged as a result.

Changes to the Itinerary: Edu School Tours anticipates that we will make no changes to the Tour and we will make every effort to ensure all Tour itineraries are accurate. Edu School Tours reserves the right to change the itinerary of the Tour due to weather conditions or any circumstances beyond our control. These decisions are final and may not be disputed during or after the Tour. If for any reason we are forced to make a change to the Tour or part of it for reasons beyond our control, prior to or during the Tour, we will advise promptly of the change but we will not be liable for any loss, damage or inconvenience suffered by you as a result of the change. 

 

GROUP TRAVEL

Group Split Fee: This fee is applied if you make a change to travel that requires a split from the group booking (“a Group Split”). For example, a group split fee may apply when you make a change to flights, dates or routings that differs from the group booking, referred to in the Proposal.

We will charge you a Group Split Fee per split.

The Group Split Fee is in addition to any applicable charge or service fees and any additional fare payable resulting from the change in flights. The Group Split Fee will be payable at the time the booking is split, for requests within 90 calendar days of departure and will be charged regardless of whether the ticket is issued or not.

The Group Split Fee is not refundable if you cancel your participation in the Tour   A Group Split Fee will not be charged when the split is required to enable you to:

  • Upgrade to a superior cabin on the same Itinerary. For example, an upgrade from economy class to business class;
  • Register for a points upgrade on the same Itinerary; or
  • Cancel your itinerary – and the cancellation occurs in the same transaction as the split.

Teacher Accommodation: Standard Policy: teachers and chaperones (same sex) will share throughout the Tour with no more than 2 adults per room. If you have specific preferences that differ from the Standard Policy, you must notify us in writing prior to advertising the student price.

The teacher accommodation for your tour is specified in the proposal document.  The cost of any variation to teacher accommodation will be the individual teacher’s /chaperone’s responsibility.  This includes additional incidental costs such as the cost of room upgrades, mini-bar, room service, in-room movies, and phone calls.

 

SUPPLIER POLICIES

Airlines

  • All quoted fares are subject to change and group seat availability at time of booking. The total ticket price may also fluctuate due to changes in Ticket Taxes.
  • The minimum group size is 20 adult passengers departing on the same flight. If the group size falls below 20 the group will no longer be eligible for group fares and the fares will be re-quoted and will increase.
  • Passenger Names are due 60 calendar days prior to departure.
  • If there is a need for unnamed seats to be held confirmed within 60 calendar days of scheduled departure; full payment per person must be received to secure the seats. If these seats are cancelled, the full payment will be forfeited as cancellation fees.
  • Within 60 calendar days, any change for the entire group will be considered as a cancellation and the deposit for each cancelling passenger will be forfeited to the airline.
  • These fares have been arranged in connection with the group, no date changes for outside that period will be permitted. If you wish to change dates to a different period for the entire group, then that will be treated as a cancellation and you will need to pay the applicable cancellation fees.

Airline baggage and weight restrictions apply for international air travel.  Details of Airline baggage and weight restrictions will be provided with Tour documentation. Your baggage and personal effects are at your own risk throughout the Tour.  Excess baggage charges imposed by airlines are your responsibility.

Hotels and other accommodation: Check In time is usually 2:00pm-3:00pm, and it unlikely your rooms will be available prior to then. Check Out time is usually 10:00am and you must vacate your room and check out by this time. You are responsible for payment of all incidental and additional costs charged by the accommodation provider, including hotel charges for phone calls, mini bar, laundry, room service, and all will other costs and expenses charged to your room. Edu School Tours cannot control the housekeeping schedules of accommodation providers, and therefore cannot guarantee when rooms will be available. All accommodation providers will hold luggage in a safe and secure location until such time as all rooms are accessible.

 

INSURANCE AND LIMITATION OF LIABILITY

Travel Insurance: If you participate in this Tour you must be  fully insured by a  comprehensive travel insurance policy. The cost of this has been included in the cost of the Tour. If you have any pre-existing medical conditions, you must provide us with full details of these conditions at the time of booking the Tour, and paying the deposit.  You are responsible for payments of any insurance costs associated with your pre-existing medical conditions.

Consular Travel Advisories and Warnings: It is your responsibility to be informed about the most current travel advisories and warnings.  We refer you to www.smartraveller.gov.au. In the event of a travel warning against travel to a Tour destination, Edu School Tours will consult embassies and or governments to confirm or cancel a tour. If the Tour continues and you choose to travel, notwithstanding any travel advisory or warning, you acknowledge you assume all responsibility and risk of personal injury, death and/or property damage. Edu School Tours is not liable for any loss, damage or expense arising from any events or travel arising from those advised or warned against.

Limit of Liability: Edu School Tours acts as an agent for Suppliers in arranging airfares, transport, accommodation admissions, workshops, restaurants and similar activities.  Edu School Tours has taken all due care and skill in selecting Suppliers but we do not make any warranties or representations regarding the services provided by the Suppliers.  Except as set out in the Contract Edu School Tours does not make any representations or warranties regarding the services we provide.  

Edu School Tours warrants that:

  • The Services will be rendered with due care and skill;
  • The Services will be fit for the purpose made known by you to us provided that you have provided us with all information relevant to your purpose;

But otherwise all warranties, conditions, rights and guarantees implied by any statute or other law are expressly excluded.  Where our liability cannot be excluded by any statute including the Competition and Consumer Act 1974 (as amended) and the Australian Consumer Law our liability shall be limited to the cost of supplying the Services again, or the cost of having the Services supplied again, at our discretion.

Without limiting the above, to the extent permitted by law, you expressly agree that your use of the Services is at your risk.   To the full extent permitted by law Edu School Tours excludes all liability to you or any other person for any loss, damage, costs, expenses or other claims (including but not limited to loss of profits, loss of revenue, 11 physical and psychological injury, and  loss or damage to property of whatever nature) that may arise as a result of directly of or in any way with the connection with the supply of the Services.

Events beyond our control: Edu school Tours does not accept liability whatsoever for injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond its control including, but not limited to, war, civil disturbance, fire, floods, acts of God, acts of government or of a all ny other authorities (whether known to the party at the time of contract or not), accident to or failure of machinery or equipment or industrial action.

 

PASSPORTS AND VISAS

Passports You are responsible for ensuring that your passport is current with minimum 6 months validity after the return date of the Tour and at least two blank pages for immigration and visa stamps.  You must provide a copy of your passport at the time of deposit payment. Expired passports, or passports that will expire prior to departure are acceptable at the time of deposit payment. If you have never held a passport, you must provide us with your birth certificate at the time of deposit payment.

Visa requirements vary for different nations. Edu School Tours will process group ESTAs for eligible passport holders. If you are travelling on a foreign (non-Australian) passport – visa costs may apply. For security reasons, airlines require your name exactly as it appears in your passport. You are responsible for proving us with the correct details. If you do not provide the correct information and we have to re-issue airline tickets or other documentation, you will bear and be responsible for all costs incurred.

E-Passports. E-Passports are now a mandatory requirement. The Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015 was signed into law on December 18, 2015. The new law requires all VWP travellers to have an electronic passport (e-passport) by April 1, 2016. Passengers are ineligible to travel under VWP without an e-passport on or after April 1, 2016.  An e-Passport, denoted by the symbol on the passport cover, is an enhanced secure passport with an embedded electronic chip. E-Passports are issued by the proper passport issuing authority and must meet international standards for securing and storing information corresponding to the passport and bearer.  The new e-passport requirement supersedes pages 15, 16, and 68 in the 2014 U.S. Customs and Border Protection Carrier Information Guide. APPLICABLE LAW

This Agreement is governed by the law of the State of Western Australia and the Commonwealth of Australia.  The parties agree to submit to the exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia. 

 

SEVERANCE

 Any provision of this Agreement  prohibited by or rendered unlawful or unenforceable under any applicable law actually applied by any court of competent jurisdiction , shall to the extent required by such law be severed from these Terms and Conditions rendered ineffective so far as is possible without modifying the remaining provisions of these Terms and Conditions.  

 

BOOKINGS

 Upon payment by you of the deposit for the Tour, you acknowledge you have received and read the Proposal and these Terms and Conditions, and are bound by them. 

 

DEFINITIONS

In these Terms and Conditions the terms:

  • “Edu School”, “we” and “us” means Redspear Holdings Pty Ltd (ACN 619 510 011) trading as Edu School Tours.
  • “Group” means the group of persons participating in the Tour.
  • “Group Member” or “you” means any person who is to participate in the Tour.
  • “Itinerary” means ….
  • “Tour” means your Edu School Tour booked through us, specified in the Proposal.
  • “Proposal” means the Proposal provided by us to you which is current at the time of payment of the deposit.
  • “Services” means the services provided by Edu School Tours to you in response to the Quotation and as varied from time to time by the parties.
  • “Supplier” means a third party supplier such as an airline, a hotel or a transport provider.
  • “Agreement” means the contract entered into between Edu School Tours and you consisting of the Proposal, your acceptance of the Proposal, whether written, verbal or by conduct, and these terms and conditions. In the event of any inconsistency between your acceptance and the terms of the Agreement, the terms of the agreement shall prevail.
